SPARKLE BEYOND - Dance Company
Terms & Conditions, Liability Waiver, and Legal Framework
Effective Date: May 25, 2026

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE PARTICIPATING IN ANY CLASS OR PROGRAM
 

By enrolling in, attending, or participating in any class, workshop, program, or event offered by Sparkle Beyond Dance Company — whether in person or via online platforms such as Zoom — you (and, if applicable, the parent or legal guardian of a minor participant) acknowledge that you have read, understood, and agree to be bound by all terms and conditions set forth in this document.

1.  About Sparkle Beyond Dance Company
Sparkle Beyond Dance Company ("Sparkle Beyond," "the Company," "we," or "us") is a dance instruction business offering classes, workshops, and programs both in-person and via live online sessions (including Zoom and similar platforms). Our mission is to provide a joyful, creative, and inclusive environment for dancers of all levels.
 

2.  Acceptance of Terms
By registering for or participating in any Sparkle Beyond class or program, you unconditionally agree to these Terms and Conditions. If you do not agree, you must not participate. These terms apply to:
•    All in-person classes, workshops, and events
•    All virtual/online classes and sessions conducted via Zoom or any other platform
•    Any guest, trial, or drop-in participation
•    Parents or guardians enrolling minor children
 

3.  Assumption of Risk — "At Your Own Risk"

3.1  Inherent Risks of Dance
Dance is a physically demanding activity. Participation involves inherent risks including, but not limited to, muscle strains, sprains, fractures, joint injuries, falls, cardiovascular stress, and other physical injuries. These risks exist regardless of the setting (in-person or virtual).

3.2  Voluntary Participation
You acknowledge that your participation is entirely voluntary. You are aware of the risks involved and freely choose to participate despite those risks.
 

3.3  Online/Virtual Class Risks
Participants joining classes via Zoom or any other online platform assume additional risks associated with exercising at home or in a self-selected environment, including but not limited to inadequate flooring, limited space, furniture hazards, lack of professional supervision of physical environment, and technical issues. Sparkle Beyond is not responsible for any injury, accident, or incident that occurs in your personal space during an online class.
 

3.4  Acknowledgment
BY PARTICIPATING, YOU EXPRESSLY ACKNOWLEDGE AND ACCEPT ALL RISKS — KNOWN AND UNKNOWN — ASSOCIATED WITH DANCE AND PHYSICAL ACTIVITY, WHETHER IN-PERSON OR ONLINE.
 

4.  Liability Waiver and Release
SPARKLE BEYOND DANCE COMPANY IS NOT LIABLE FOR ANY INJURIES OCCURRING DURING OR IN CONNECTION WITH CLASSES OR PROGRAMS

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Sparkle Beyond Dance Company, its owner(s), instructors, employees, agents, volunteers, representatives, successors, and assigns (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or relating to:
•    Any injury, illness, damage, or death — whether caused by negligence or otherwise — occurring during or in connection with participation in any Sparkle Beyond class, workshop, or event
•    Injuries sustained during in-person classes at any studio, venue, or location
•    Injuries sustained during virtual/online classes in your personal environment
•    Any loss or damage to personal property
•    Any accident, incident, or emergency arising during participation

You agree that the Released Parties shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your participation, regardless of whether Sparkle Beyond was advised of the possibility of such damages.
 

5.  Medical Clearance and Health Responsibility
You represent and warrant that:
•    You are in adequate physical condition to participate in dance activities
•    You have consulted with a physician or medical professional if you have any pre-existing medical conditions, injuries, or concerns
•    You will immediately stop participating if you feel pain, dizziness, shortness of breath, or any other physical discomfort
•    You will notify the instructor of any relevant medical conditions or injuries before participating

Sparkle Beyond strongly encourages all participants to obtain medical clearance before beginning any new physical activity program. The Company assumes no responsibility for adverse health events arising from failure to disclose relevant medical information.

6.  Minor Participants
If you are enrolling a minor (a person under the age of 18), you, as the parent or legal guardian:
•    Represent that you have the legal authority to enter into this agreement on behalf of the minor
•    Agree to all terms and conditions in this document on behalf of yourself and the minor
•    Assume full responsibility for the minor's participation and safety
•    Acknowledge and accept all risks described herein on behalf of the minor
•    Release the Released Parties from all claims arising from the minor's participation
 

7.  Code of Conduct and Class Policies

7.1  Respectful Environment
Sparkle Beyond is committed to providing a safe, welcoming, and inclusive environment. All participants are expected to treat instructors, staff, and fellow students with respect. Harassment, bullying, or discriminatory behavior of any kind will not be tolerated and may result in immediate removal from the program without refund.
 

7.2  Appropriate Attire
Participants are responsible for wearing appropriate dance attire and footwear as recommended by the instructor. Sparkle Beyond is not responsible for injuries related to improper or unsafe clothing or footwear choices.

7.3  Tardiness and Attendance

Classes begin on time. Participants who arrive late do so at their own discretion and risk. Chronic absences do not entitle participants to make-up classes or refunds unless otherwise specified in writing by the Company.
 

7.4  Recording Policy
No participant may record, photograph, or livestream any Sparkle Beyond class or session — in-person or virtual — without the prior written consent of the instructor and all identifiable participants. Any authorized recordings are for personal use only and may not be distributed, posted, or shared on any platform without express written permission.
 

8.  Payment and Refund Policy
ALL SALES ARE FINAL — NO REFUNDS WILL BE ISSUED
 

8.1  No Refund Policy
Sparkle Beyond Dance Company maintains a strict no-refund policy. Once payment has been made for any class, workshop, session package, membership, or program:
•    No refunds will be issued for any reason, including but not limited to scheduling conflicts, personal circumstances, illness, change of mind, or dissatisfaction
•    No partial refunds will be issued for unused sessions within a package
•    No refunds will be issued for classes missed due to late enrollment, tardiness, or absence
 

8.2  Class Cancellations by Sparkle Beyond
In the event that Sparkle Beyond cancels a scheduled class or session, participants will receive a class credit or reschedule opportunity of equivalent value. No monetary refunds will be issued.
 

8.3  Transfer Policy
Class credits may, at the sole discretion of Sparkle Beyond, be transferred to another participant or applied toward a future class or program. Transfer requests must be submitted in writing and are not guaranteed.
 

8.4  Chargebacks
Initiating an unauthorized chargeback or payment dispute with your bank or credit card provider is a breach of these Terms. You agree to resolve any payment disputes directly with Sparkle Beyond before contacting your financial institution.
 

9.  Intellectual Property
All choreography, class content, instructional materials, music selections, and creative works created or used by Sparkle Beyond Dance Company are the intellectual property of the Company and its owner(s). Participants may not reproduce, distribute, teach, perform publicly, or otherwise use any Sparkle Beyond content without prior written permission.
 

10.  Online and Virtual Class Terms
The following additional terms apply to all classes conducted online or via video conferencing platforms such as Zoom:
•    You are responsible for ensuring a safe and adequate physical space for participation, including sufficient room to move, appropriate flooring, and removal of hazards
•    Sparkle Beyond is not responsible for technical issues, internet connectivity problems, or platform outages
•    You agree to comply with the platform's terms of service
•    Virtual classes are for personal use only; sharing links or access credentials with non-enrolled individuals is prohibited
•    Sparkle Beyond reserves the right to remove any participant from a virtual session for disruptive behavior without refund
 

11.  Privacy and Photography
Sparkle Beyond may photograph or record classes and events for marketing, social media, and promotional purposes. By participating, you grant Sparkle Beyond a non-exclusive, royalty-free license to use your likeness (and that of your minor child, if applicable) in such materials. If you do not wish to be photographed or recorded, please notify us in writing prior to the class.
 

12.  Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
•    Your participation or the participation of your minor child in any Sparkle Beyond class or event
•    Your breach of these Terms and Conditions
•    Your violation of any applicable law or third-party right
 

13.  Modification of Terms and Programs
Sparkle Beyond reserves the right to modify, update, or change these Terms and Conditions, class schedules, instructors, pricing, and program offerings at any time without prior notice. Continued participation following any modification constitutes acceptance of the revised terms.
 

14.  Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada. Any dispute arising out of or related to these Terms shall first be subject to good-faith negotiation between the parties. If unresolved, disputes shall be submitted to binding arbitration in Clark County, Nevada, in accordance with applicable arbitration rules. You waive any right to a jury trial in connection with any dispute related to these Terms or your participation in Sparkle Beyond programs.
 

15.  Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
 

16.  Entire Agreement
These Terms and Conditions, together with any enrollment forms or supplemental agreements provided at registration, constitute the entire agreement between you and Sparkle Beyond Dance Company with respect to your participation and supersede all prior understandings, representations, and agreements, whether written or oral.

If you have any questions regarding these Terms and Conditions, please contact Sparkle Beyond Dance Company directly prior to enrollment or participation.
 

ACKNOWLEDGMENT AND AGREEMENT

By taking a class, I confirm that I have read, understand, and agree to all Terms and Conditions set forth in this document. I acknowledge that this is a legally binding agreement and that I am entering into it voluntarily.
